2018 saw the biggest change in European privacy law in over 25 years with the implementation of the General Data Protection Regulation (the GDPR) in May.

The ongoing impasse in the Brexit negotiations means that many of the legal implications of the UK’s departure from the EU are yet to be addressed or clarified. 

On 21 December 2018, the Data Protection Commission (“DPC”) published a preliminary guidance in relation to the impact of a “no deal” Brexit on personal data transfers.

France’s data protection regulator (the “CNIL”) has imposed a €50 million fine on Google for failing to comply with EU data privacy laws. The fine is the highest yet to be imposed on an organisation under the General Data Protection Regulation (“GDPR”), which was enacted on 25 May last year.

On 1 August 2018, new Superior Court, District Court and Circuit Court Rules came into operation allowing “bona fide” members of the media to request disclosure of information contained in a court record.
