Martha Wilson - Partner

Martha is a partner in the Healthcare team at Hayes solicitors. She works primarily in healthcare litigation, defending personal injuries claims taken against the Health Service Executive as well as against individual medical and dental practitioners.

In addition to contentious matters, Martha also advises on healthcare care related non-claims issues and represents doctors and dentists in relation to complaints to the Medical Council and Dental Council.

Experience

  • Works as part of a two-solicitor team defending high value catastrophic injury cases including cerebral palsy and brain injury claims. These cases involve comprehensive investigations into the complex issues of liability, causation and quantum, and careful management of the practical procedures involved in running complicated litigation
  • Vast experience defending cases arising from a wide variety of medical and dental scenarios such as missed cancer diagnoses; orthopaedic injuries; nerve injury; gynaecological injuries; eye surgery; and claims related to vascular injuries and missed vascular / arterial conditions
  • Many of Martha’s cases involve allegations of negligence against dental practitioners. Common issues include consent, treatment planning, record keeping, chemical burns, appropriate use of medications, full mouth restorations, cosmetic dentistry and nerve injuries. She looks after these cases in the High Court, Circuit Court and District Court
  • Acts for plaintiffs in personal injuries claims, other than medical negligence. These cases usually arise from road traffic accidents and “trips and falls”
  • As well as contentious matters, she also regularly advises clients, both healthcare and others, on privacy, confidentiality, Data Protection and Freedom of Information
  • Martha also advises from time to time on Judicial Reviews against public bodies.

  • Bachelor of Civil Law (European), University College Dublin
  • Diplôme d’Etudes de l’Union Européenne (Diploma in European Union Studies), Université de Toulouse
  • Master of Laws in Commercial Law, University College Dublin
  • Professional qualification as a solicitor, Law Society of Ireland, 2007
