The Law Reform Commission has published an Issues Paper on reporting of Court proceedings.

As most recently demonstrated in O’Reilly & Anor v Neville & Ors, we are seeing a trend towards a more nuanced approach to the awarding of legal costs in litigation.

Last month, the Supreme Court affirmed a 2011 decision of the High Court that a third party who funds litigation, although they are not a party to the proceedings, may be liable for legal costs incurred by the other side.

This Act was signed into law in June 2018 and it introduces important powers to combat corruption and bribery in Ireland.

As the above maxim suggests it is an essential tenet of the effective administration of justice that proceedings must progress to hearing without significant delay. Accordingly, the courts have the right to strike out proceedings for want of prosecution.
