Lyn McCarthy - Partner

Lyn is a partner in the Healthcare team at Hayes solicitors. Lyn advises clinical practitioners and indemnity bodies in respect of the defence of medical negligence claims and also in respect of the defence of professional disciplinary matters before Committees of inquiry.  

Prior to joining Hayes solicitors, Lyn worked with an established Legal 500 and Chambers ranked Dublin firm where she advised several healthcare regulators in the context of professional disciplinary matters.  Lyn has lectured at the Law Society of Ireland in the area of professional regulation and tutors at the Law Society of Ireland in the area of civil litigation.

Experience

  • Plaintiff and Defence Litigation: In her current role at Hayes, Lyn defends a varied caseload of medical negligence claims at High Court and Circuit Court level, including claims alleging delay in diagnosis, obstetric and gynaecological injuries and surgical errors.

    Lyn has previously advised plaintiffs in respect of medical negligence matters, a wide variety of personal injuries matters, fatal injuries cases and applications to the Criminal Injuries Compensation Tribunal.

  • Regulatory Advisory: Lyn has advised several healthcare regulators in respect of the discharge of their statutory functions in respect of professional disciplinary matters, to include regulatory investigations and the admissibility of evidence obtained in the context of Garda investigations/ Internal Investigations/ Investigations by other regulators in subsequent fitness-to-practise inquiries.
  • Regulatory Inquiries: Lyn has acted for various healthcare regulators in the context of Fitness to Practise Inquiries in respect of healthcare professionals relating to a wide variety of clinical matters, to include: obstetrics and gynaecology, emergency medicine, surgical errors, delayed diagnosis, psychiatry, prescribing, dispensing errors.

    Lyn has also acted in the context of Inquiries in respect of medical professionals relating to alleged professional misconduct and alleged impairment of the medical professional’s ability to practise by reason of medical disability. Lyn has experience in presenting applications before Disciplinary Committees of regulators.

  • Inquest: Lyn advises hospitals and medical practitioners at Inquests. Lyn has previously advised regulators in respect of matters arising from Inquests, to include subsequent statutory Inquiries.
