Jeremy Erwin - Partner

Jeremy is a partner in the Commercial & Business team at Hayes solicitors. He practises predominately in insolvency, commercial litigation and dispute resolution, acting for a variety of companies and financial institutions in contract law cases and enforcement and recovery actions in the High Court. He also advises clients in high value complex Commercial Court proceedings.

Jeremy also specialises in intellectual property matters, including the advising global clients on registration and protection of trade marks and related rights in Ireland and Europe. He has also advised extensively on trade mark disputes before the Irish Courts including one of the most recent leading intellectual property cases in Ireland, and disputes before the EU trade mark body. Jeremy also advises clients on a wide range of commercial and business law matters in particular company law obligations, and company law enforcement.

Experience

  • Commercial litigation– Jeremy has advised on a wide range of financial institutions on high value enforcement and recovery strategies in the High Court, Commercial Court, and relevant enforcement action in the Circuit Court. This includes advising banks, financial institutions, receivers, and liquidators on commencing litigation against borrowers, guarantors, Estates/ Personal Representatives; bringing receivership injunctions; bankruptcy; advice on enforcement over pensions; asset transfer reversal proceedings, compliance with loan and security documentation and applicable codes of codes of conduct
  • Advises clients from various sectors including tech start-ups, franchisors, suppliers, public and private companies, and financial institutions, on bringing and defending High Court proceeding including interim and interlocutory injunctions to assert or defend their various interests
  • General commercial litigation - advices on breach of contract, disqualification and restriction of directors, fraudulent preference proceedings, company law obligations, construction law advices
  • Data protection law – advises companies and State bodies on general data protection queries, as well as specific and complex issues arising
  • Intellectual property – advises both individual and corporate clients on registering trade marks in Ireland, Europe and globally, and the protection of their intellectual property in Ireland. He has also been involved in a number of intellectual property disputes including asserting rights over various trade marks and defending claims for breach of database and intellectual property rights. He gained invaluable experience while on secondment to one of Ireland largest retailers, which included both enforcing and defending IP claims.

  • Higher Diploma in Legal Studies, Portobello College, Dublin
  • Professional qualification as a solicitor, Law Society of Ireland, 2012.
