Cian Clinch - Partner

Cian is a partner in the Commercial & Business team at Hayes solicitors. He predominantly specialises in commercial litigation and dispute resolution and has acted for a wide variety of private companies, State bodies and financial institutions in contract law cases, enforcement and recovery actions and personal injuries litigation. These disputes are generally progressed through the High Court or Commercial Court and many are resolved through Alternative Dispute Resolution, such as arbitration and mediation.

Cian also provides advice on a wide range of commercial and business law matters, including the negotiation, review and drafting of commercial contracts, data protection law and construction law.

Experience

  • Commercial Court Litigation - Advised in numerous high profile and complex disputes covering a broad range of business and regulatory issues.
  • Discovery - Oversaw a number of large discovery projects, including successful applications for the use of technology assisted review / predictive coding, the review of documents to assist with the training of the predictive coding algorithm and the management of large review teams.
  • Commercial Agreements - represents clients in the negotiation and drafting of various commercial and technology agreements, including licence agreements, software agreements and master services agreements.
  • Enforcement disputes - Represents financial institutions, hedge funds and receivers in connection with a variety of enforcement disputes, including applications for summary judgment, vacant possession and mareva injunctions.
  • Data protection law - Advises companies and State bodies in relation to their data protection obligations under the General Data Protection Regulation and E-Privacy law.  
  • Construction law - Acts for large multinationals in the negotiation and drafting of construction contracts and advises on issues that arise throughout construction.
  • Defamation - Acted on a number of High Profile defamation cases before the High Court, Court of Appeal and Supreme Court.
  • Personal Injuries - Regularly represents the State Claims Agency in respect of Employer/ Public Liability claims.
  • In house experience - Worked in the legal departments of Primark and IBRC on secondment from Hayes.

  • Certificate in Commercial Contracts, Law Society of Ireland, 2019
  • Bachelor in Civil Law degree, University College Cork
  • Master in Laws, Trinity College Dublin
  • Professional qualification as a solicitor, Law Society of Ireland, 2014.
