Ruth Sharkey - Associate

Ruth is an Associate Solicitor in the Healthcare team at Hayes Solicitors.

Ruth specialises in defending both Hospitals and individual Healthcare Providers against clinical negligence litigation proceedings in the Superior Courts and regulatory complaints before the Irish Medical Council. 

Prior to joining Hayes, Ruth trained and practised in London with a highly ranked Legal 500 and Chambers international commercial law firm specialising in insurance, dispute resolution and advisory services.  Ruth also practised with two ‘top five’ Dublin firms in the areas of clinical negligence and insurance litigation.

Healthcare

  • Ruth’s Healthcare experience includes defending high value complex claims involving cerebral palsy, neurological injuries, birth injuries, delayed diagnosis, psychiatric injuries, orthopaedics, surgical injuries and GP negligence.
  • Ruth also provides general advice on healthcare issues including consent to treatment, mental capacity, clinical risk and complaints.

Insurance

  • Ruth’s Insurance experience includes defending high value complex catastrophic injury claims in relation to motor and rail liability, employers’ liability, public liability, product liability and occupational disease (Claim values £150,000 - £10 million).
  • Losses include brain and spinal injury, multiple trauma, interim payments, periodical payments, care funding and rehabilitation management often with a foreign element.
  • Claims issues include negotiation, fraud and malingering, policy coverage, jurisdiction and international claims, and pre-litigation claims handling.

Life Sciences

  • Ruth previously advised multinational pharmaceutical and medical device companies on life sciences regulation and product liability litigation in Ireland and the EU.
  • Her Life Sciences experience includes advising on clinical trial authorisations, advertising and supply of regulatory products, licensing of medicinal marijuana, data protection in the healthcare sector and arrangements with distributors, healthcare practitioners and organisations.
