Tomás Nyhan - Associate

Tomás is an associate solicitor in the Property team at Hayes solicitors. He has extensive experience in all aspects of property transactions acting for both vendors and purchasers in the sale and purchase of residential, commercial and retail property. Tomás has also acted for clients in the acquisition and subsequent development of residential, commercial and retail developments and advises both landlords and tenants in all aspects of commercial leases.

Tomás also works closely with the Banking and Financial Services team advising on all matters of Property Law as well as acting for banks, financial institutions, state bodies, liquidators and receivers in the disposal of property.

Experience

  • Acted in the acquisition and subsequent development of green field sites for residential, commercial and retail developments including advising on the incorporation of management companies and obligations under Multi Unit Development Act
  • Negotiated and drafted commercial leases on behalf of both landlords and tenants of stand-alone premises and multi-unit developments including advising clients on covenants, rent reviews, management and service charges, repairs, insurance and easements, rights and privileges
  • Drafted and advised on short term letting agreements, licences and concessions
  • Advised in the sale, purchase and leasing of licensed premises and in the acquisition, disposal and transfer of liquor licences
  • Acted for a client in respect of the acquisition by lease of a fuel station and retail shop from a major multinational fuel distributor
  • Extensive experience in the sale of distressed properties on behalf of receivers and liquidators including where properties have been acquired by NAMA
  • Acted for vendors and purchasers in the purchase and disposal of residential dwelling houses and apartments
  • Experienced in investigating unregistered and registered title for urban and rural properties and drafting contracts for sale, deeds and various agreements
  • Regularly carried out title reviews on behalf of lending institutions and advised on title defects and perfection of title
  • Acted in the purchase, sale and leasing of farmland and forestry plantations
  • Drafted and negotiated rectification of boundaries, various easements, rights of way and wayleaves including attending to registration of easements acquired by prescription under the Land and Conveyancing (Law Reform) Act 2009

  • Professional qualification as a solicitor, Law Society of Ireland, 2008
  • Certificate in English & Welsh Property Law, Law Society of Ireland
