Mary Kelleher - Consultant

Mary is a Consultant in the Employment Law team at Hayes Solicitors. Mary advises domestic and international clients on all aspects of the employment relationship, including contentious and advisory matters. This includes assisting employers and senior executives in navigating the complex and multifaceted issues arising in the conduct of workplace investigations, crisis management, whistleblowing/protected disclosures, internal grievance, disciplinary and bullying & harassment procedures, management of organisational change, as well as the termination of employment.

Mary also advises on the employment aspects of corporate transactions and outsourcing arrangements, including the implications of the Transfer of Undertakings Regulations (TUPE), as well as individual and collective redundancy requirements, restrictive covenants, social media, equality and discrimination issues.

Mary gives pragmatic and solution driven advice to clients and has considerable experience managing complex employment litigation, including employment injunctions, before all employment fora, including before the Circuit/High Court, the Workplace Relations Commission and Labour Court. Mary regularly lectures and provides specifically tailored training on all employment related issues to clients.

Experience

  • Advised on multiple complex High Court litigation cases and claims before the Workplace Relations Commissioner and Labour Court, including injunctions, for banking, insurance and financial services institutions.
  • Advised employers in the third level sector on a myriad of employment issues and managing extensive employment litigation arising, including the successful defence of a claim for gender discrimination claim before the High Court in relation to academic promotion, claims under the Fixed-Term legislation for contracts of indefinite duration, as well as claims for employment status in the context of atypical working arrangements.
  • Advised an international employer on the employment aspects of a major M&A transaction, including the transitioning of key personnel benefits/contracts of employment to Ireland.
  • Advised public sector organisations on a multitude of employment issues, including workplace investigations, social media and the conduct of significant claims under the Employment Equality and Equal Status Acts.
  • Advising companies in the technology, pharmaceutical and medical device sector in relation to employment law issues and claims.

  • Professional qualification as a solicitor, Law Society of Ireland, 2002
